Preamble:

The present conditions are agreed upon between, on the one hand, the company Nova Parts Iberica S.L:

• Hereinafter referred to as "Nova Parts Iberica S.L"

And, on the other hand, individuals wishing to make a purchase through the website of Nova Parts Iberica S.L (www.range2win.com), hereinafter referred to as the "Consumer".

 

Article 1: Purpose

The present general terms and conditions of sale are intended to define the terms and conditions under which sales by correspondence between Nova Parts Iberica S.L and its customers are carried out. Our sales are subject to these general terms and conditions, which prevail over any other stipulation from the customer or Nova Parts Iberica, whether written or not.

The present general terms and conditions concern the items offered for sale in this catalog. The photographs of these items are not contractual. Other offers listed in the catalog can also be ordered, but under their own specific conditions, which will be communicated by Nova Parts Iberica S.L.

 

Article 2: Applicable Law

2.1 Applicable Law

Note: All items presented in this catalog must comply with the legislation in force in your country.

2.2 Approval

Title V - Special provisions applicable to motorcycles and mopeds. Article 188. (D.N°80 14 of January 9, 1980) The term "mopeds" refers to any vehicle equipped with an auxiliary thermal engine with a displacement not exceeding 50 cubic centimeters, having the normal characteristics of bicycles in terms of their possible use, and whose speed does not exceed 45 kilometers per hour.

An order from the Minister of Transport and the Minister of Industry defines the conditions for the application and control of the provisions of this article and sets deadlines for its implementation. All items marked as "not approved" are authorized only for competition or private use off public roads.

 

Article 3: Order

3.1 Acceptance

Placing an order implies full and unconditional acceptance of these general terms and conditions of sale by the consumer. Any opposing condition set by the consumer will be unenforceable.

In the event of unavailability due to temporary or permanent cessation of production of the ordered items, Nova Parts Iberica S.L undertakes to refund the order or offer the consumer an item of equal or superior quality, at an equal or lower price.

3.2 Capacity - Minor

The parties agree that minors placing an order are acting as representatives of their parents.

3.3 Right of Withdrawal

The right of withdrawal is fifteen business days from the date of receipt of the items by the consumer (delivery date). In the event of exercising the right of withdrawal, Nova Parts Iberica S.L is obliged to refund the amounts paid by the consumer, without fees. Refunds are made immediately after validation. However, depending on the payment method used or the processing times of the bank, the receipt of funds may take up to 30 days. In case of withdrawal, the credit contract linked to the distance sale is terminated without penalty. The right of withdrawal applies only if the product has not been used and/or assembled and the packaging has not been damaged, so that the product can be resold. The return costs are borne by the consumer.

3.3.1 Order Cancellation

The consumer has the possibility to cancel an order before it has been shipped, provided that the following conditions are met:

• The cancellation must be requested through Nova Parts Iberica S.L.'s customer service, using the contact form available on the website.
• Cancellation requests will only be accepted if the order has not been processed for shipment.

If cancellation is not possible because the order has already been shipped or prepared for shipment, the consumer will be informed, and the return policies described in ARTICLE 7 will apply.

3.4 Payment

Orders are subject to confirmation by Nova Parts Iberica S.L via email to the address provided by the consumer.

3.4.1 Payment by Bank Card:

Payment is made directly on the secure platform of our bank, which means that no bank information can be diverted by third parties. Nova Parts Iberica S.L certifies that it does not retain any banking information entered during the order process. All bank details are transmitted in real-time to our financial institution. Payment Security: Your credit card details are encrypted using SSL (Secure Socket Layer) protocol and never transit in clear text over the network. The payment is made directly to your bank. Range2win.com does not have access to these details and does not store them on its servers.

3.4.2 Payment by PayPal:

Payment is made on the PayPal server through an SSL encrypted page. Thus, the payment is perfectly secure. This payment option is only available if you have a PayPal account!

3.4.3 Payment by Bank Transfer:

Once your order has been validated, it will be on hold for 15 days without product reservation. You will be able to consult the RIB of Range2win.com on the order confirmation received by email in order to make the bank transfer. Once the transfer is received in our account, your order will be validated. Attention: Make sure to bear the transfer fees and not deduct them from the order amount. Note that the announced shipping time may vary depending on the date of receipt of your payment.

3.4.4 Payment by Bizum (available only in Spain):

Payment via Bizum is a simple and fast option, available only for customers located in Spain. When finalizing your order, select Bizum as the payment method. You will be redirected to the secure Bizum platform to make your transaction safely.

Thanks to this system, Nova Parts Iberica S.L does not store any bank data. Security is guaranteed by the SSL encryption protocol, ensuring total confidentiality of your information. Once the payment is validated, your order will be immediately confirmed and processed.

 

Article 4: Prices

The prices listed in Nova Parts Iberica S.L's price list are non-binding and are indicative. The prices of the products sold by Nova Parts Iberica S.L are effective on the day of the order. The company Nova Parts Iberica S.L reserves the right to revise its prices in case of exceptional events beyond our control.

The shipping costs (excluding applicable duties and taxes in your country) will be indicated when choosing the delivery method.

4.1 European Union

The prices listed on the Nova Parts Iberica S.L website are quoted including all taxes (TTC). In accordance with agreements, VAT has been included in the price of the products, and no further tax or customs duty will be due upon delivery (except for DOM-TOM).

4.2 DOM-TOM

For orders destined for DOM-TOM, products will be invoiced without taxes, and you will have to pay shipping costs calculated according to the destination country and the weight of the package. Upon receipt of the package, you will need to pay, in addition, customs duties, VAT, and other local taxes, depending on the destination country. For DOM, you will have to pay the local VAT (except for French Guiana), octroi de mer, and regional octroi de mer. You will not have to pay customs duties.

For TOM, you will have to pay the local VAT (applicable only in French Polynesia) and customs duties.

Regarding shipments to DOM/TOM and outside the EU, we draw your attention to two points: all duties and taxes are calculated by customs services on the order amount, including transport.

 

Article 5: Reservation of Ownership

The company Nova Parts Iberica S.L retains ownership of the goods sold until full payment of the price. (Law N° 85.98 of 25/01/85 art 121). The risks are borne by the buyer upon delivery of the goods sold under retention of title. The buyer must ensure their conservation at his own expense and risk. In the event of non-payment of any amount due under the sale, the sales contract will be terminated automatically, at the discretion of the seller, without the need for any judicial formalities, eight days after a simple formal notice by registered letter remains unanswered. The return by Nova Parts Iberica S.L of the claimed items imposes on the buyer the obligation to compensate for the depreciation and, in any case, the unavailability of the retained goods.

 

Article 6: Transport, Delivery, and Shipping Times

6.1 Transport

• In the event of damage to the package delivered by a carrier, the customer must refuse the package or mention "damaged package" on the delivery slip. Any signature accepting the delivery implies acceptance of the state of the goods, and therefore, no claim will be accepted against the carrier.
• In the event of products damaged inside the package, which are not visible at the time of delivery, you have 48 hours to make a claim for "damage upon unpacking." Contact Nova Parts Iberica's customer service through the contact form, including a photo of the item and a description of the problem. After this period, no claim will be accepted.
• In the case of a missing product, the procedure is the same as the one previously mentioned. We will perform an IT control of your order initially. Keep the carrier's label attached to your package, mentioning the weight, as it may be requested in the event of a second verification. Without compliance with these three conditions, no claim will be accepted.

6.2 Delivery

The delivery of the items ordered online will be made to the address indicated by the customer when placing the order. If the address provided by the customer is incorrect or erroneous and the carrier returns the order to Nova Parts Iberica S.L, Nova Parts Iberica S.L will send an email to inform the Consumer. Reshipping costs will be borne by the Consumer. Remarks: No compensation can be claimed if the deadline is not met due to a strike, accident, natural disaster, or any other event for which we cannot be held responsible. Orders are shipped only if all items in the cart are available in the Nova Parts Iberica S.L stock (except in exceptional cases, such as a customer requesting shipping in two parts and paying for shipping for the second part of the shipment). Example: 1 cylinder available in stock and a variator available in 10 days, your order will be shipped complete when the variator is in stock. Products not available in stock are then ordered from our manufacturers or suppliers; the times indicated on the website are for reference only. However, with particular attention, if, for any reason, the pending product becomes unavailable or unavailable for more than 15 days, we will notify the Consumer. Shipments are made from Monday to Friday.

6.2.1 Delivery Mode

6.3 Shipping Times

Shipping times are communicated as an indication, depending on our procurement and transportation possibilities. Some products are imported from abroad; the seller will do its best to deliver them to the buyer as soon as possible. However, it cannot commit to a strict shipping deadline, and this cannot give rise to damages. The same applies to cases of force majeure.

6.4 Force Majeure

Force majeure events that exempt the seller from its obligation to deliver within the initially specified times include strikes, fires, floods, wars, riots, accidents, production stoppages, inability to procure supplies, and stock shortages. The seller will notify you promptly if any of the aforementioned events occur.

 

Article 7: Returns - Modalities

Range2win.com offers the possibility of a return within 14 calendar days from the receipt of the product.

Contact customer service within 14 days of the date of receipt of your order. You will be able to obtain a return form provided by customer service after receiving photos of the products and their packaging.

For returns made by the customer, we highly recommend opting for a shipment with tracking, as the goods are at the sender's risk.

Once received in our warehouses, our technical service will inspect your merchandise and, after inspection, we will process the refund using the payment method used during the purchase.

If payment was made by bank transfer, please provide your IBAN + BIC.

7.1. Return Conditions

The item must be returned in a box other than that of the supplier and must comply with the following conditions:

The product must not have been mounted or used under any circumstances.

The packaging must be in perfect condition for resale to customers. If this condition is not met, the return may be refused, or a reconditioning fee may be deducted from the refund.

The return form must be placed inside the package; in its absence, the processing of the Customer Service will take longer.

Failure to comply with these conditions will result in the systematic return of the product to your billing address.

In the event of an error on the part of the Consumer during the purchase, a warranty request, or simply a desire to return an item, the shipping costs for the return will be borne by the Consumer. However, in the event of an error on our part, such as an incorrect product reference, labeling, an incomplete product, or for any other reason, the return costs will be fully borne by us.

 

Article 8: Warranties (Return Merchandise Authorization)

All products sold by Range2win.com come with:

- Legal warranty

- Legal warranty for hidden defects

- Damage warranty upon unpacking (valid for 24 hours from package delivery with photo presentation)

Nova Parts Iberica S.L disclaims all liability for damage caused by seizing, engine failure due to incorrect use, incorrect installation, or faulty engine tuning.

No claims for collateral damage, labor costs, etc., due to abnormal use of the part, will be accepted.

Any warranty request must be expressly made to the customer service with a description and photo of the problem encountered.

The technical service will then grant the return authorization in order to be able to carry out the warranty procedures with the manufacturer.

The manufacturer reserves the right to reject or validate the warranty. Nova Parts Iberica S.L cannot be held responsible for any rejection.

Please note that no warranty is provided for parts intended for competition.

Shipping costs are to be borne by the customer.

Warranties do not cover the following items:

- The use of products intended for competition, especially those equipped with displacements greater than the original (such as Big Bore cylinders).

- The installation of non-approved competition parts.

- Defects and their consequences related to any external cause.

8.1: Extended Warranty

Warranty interventions shall not have the effect of extending the duration of the warranty. The presentation of the invoice will be strictly required when the warranty is invoked. Under the warranty, the only obligation of the seller will be the free replacement or repair of the product or element recognized as defective by its services. Any product called upon to benefit from the warranty must first be submitted to the seller's after-sales service, whose approval is indispensable for any replacement. Possible shipping costs are to be borne by the buyer.

8.2: Warranty Exclusion

Defects and damage caused by natural wear or by an external accident (disassembly, incorrect installation, defective maintenance, abnormal use, etc.) or by a modification of the product not planned or specified by the seller are excluded from the warranty. Similarly, the warranty will not be valid for apparent defects, which the purchaser must claim under the conditions of Article 7. The user must take responsibility for the homologation required by any change that the addition of the ordered product may cause. The seller's liability cannot be invoked in case of competition use.

8.3: Hidden Defects

The seller is liable for hidden defects in the sold part that make it unsuitable for the intended use or which reduce its use so much that the buyer would not have purchased it or would have paid a lower price if he had known about them, in accordance with the provisions of articles 1641 and subsequent of the Civil Code. However, no warranty will be due if the sold part has been modified without the prior written consent of the manufacturer or if the part has been repaired or maintained by persons not authorized by the seller, or if the part is used abnormally or under abnormal conditions with reference to the manual provided by the manufacturer.

8.4: Characteristics of Articles

Note that certain products are characterized by the label "Not approved"; this means that their use on public roads, within the scope of normal use provided for by the Road Code, is prohibited.

Under no circumstances shall Nova Parts Iberica S.L be held liable if these conditions are not respected.

 

Article 9: Data Protection

In accordance with the Data Protection Act of January 6, 1978, you have the right to access and rectify your data.

 

Article 10: Domicile Choice

The company Nova Parts Iberica S.L chooses domicile at the location of its headquarters: C/ Tenerife, Nº22, 03725, Teulada, (Alicante), Spain.

 

Article 11: Personal Data

Nova Parts Iberica S.L reserves the right to collect data about the consumer, particularly through the use of cookies. The collection of data by Nova Parts Iberica S.L is necessary to handle the Consumer's requests. By providing their email address to Nova Parts Iberica S.L, the Consumer may receive an order confirmation. Depending on the choice made during the creation or consultation of their account, the consumer may receive offers from Nova Parts Iberica S.L by email.

Nova Parts Iberica S.L implements all means to ensure the confidentiality and security of the data transmitted on the web.

 

Article 12: Intellectual Property

All elements of the Range2win.com site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks, or patents.

Thus, none of the documents from the Range2win.com site may be copied, reproduced, republished, downloaded, posted, transmitted, or distributed in any way, except under the following conditions: it is possible to download a copy of the documents to a computer for your personal use and solely for non-commercial purposes, provided that the information is not modified and all copyrights and other proprietary notices are kept intact. Modifying these documents or using them for another purpose constitutes an infringement of Nova Parts Iberica S.L's intellectual property rights.

The consumer who has a personal website and wishes to place, for personal use, a simple link directly to the homepage of the Range2win.com site must request authorization from Nova Parts Iberica S.L. In no case shall this be an implied affiliation agreement.

On the other hand, any hyperlink to the Range2win.com site using the framing or in-line linking technique is strictly prohibited.

In any case, any link must be removed upon simple request from Nova Parts Iberica S.L.

Trademarks, logos, photos, videos, animations, visuals, drawings, and models appearing on this site are the exclusive property of Nova Parts Iberica S.L. Their disclosure should not be interpreted as granting a license or right of use of said trademarks and distinctive elements protected by copyright. They cannot be used under penalty of infringement.

 

Article 13: Integrity

In the event that any clause of this contract is null and void due to a change in legislation, regulations, or a judicial decision, this shall in no way affect the validity and observance of the present general terms and conditions of sale.

 

Article 14: Duration

The present conditions apply throughout the duration of the services offered online by Nova Parts Iberica S.L.

 

Article 15: Proof, Storage, and Archiving of Transactions

The computerized records, kept in the computer systems of Nova Parts Iberica S.L and its partners under optimal security conditions respecting the European security protocols in force (GDPR...), will be considered proof of the communications, orders, and payments made between the parties. The archiving of order forms and invoices is carried out on a protected and durable medium to provide a faithful and secure copy.
